How Much Would I Get If I File A Darvon Lawsuit?

Darvon and Darvocet, medication both manufactured by Xanodyne Pharmaceuticals, Inc., were pulled out from the market in compliance with the U.S. Food and Drugs Administration’s request for a market recall. Mild to moderate post-surgical pain is relieved by Propoxyphene, a higly addictive opiod drug, which is the main ingredient of both medication. The request that the drug be banned from the market was issued in November as it was found to increase the likelihood of fatal heart abnormalities among individuals who take it. Other companies manufacturing generic brands of this drug is expected to follow suit.

As more facts and patients surface, Darvon lawsuits are likely to be filed. To date, one individual has already filed a class action suit against Xanodyne on behalf of other takers of Darvon and Darvocet, alleging that the manufacturer failed to issue a warning about the risks associated with the drugs.

Linda Gallagher filed a Darvon lawsuit in the district court of New Orleans seeking compensatory damages, medical monitoring fees, court costs and attorney fees for everyone included in the class action. As lead plaintiff, Ms. Gallagher asserts that she has suffered two heart attacks since she started taking Darvocet in 2007.

It is expected that similar incidents have happened to a number of people who have taken propxyphene-containing medication. As you weigh your options in taking legal action against the manufacturer, it may have crossed your mind to wonder the amount you may receive in compensation. More details are needed to determine as to the amount of compensation the manufacturers of the drugs settle on. But since the recall request issued by the FDA is fresh, similar lawsuits such as ones against makers of Vioxx, Celebrex and Vestra can be used as examples to provide you with an idea on what cases like these pay in damages.

Vioxx was manufactured by Merck & Co., Inc., to alleviate pain, fever and inflammation. In 2005, Vioxx was withdrawn from the market after discovering that it can double a patient’s risk for heart attacks and strokes. $4.85 billion in total damages were paid to thousands of plaintiffs.

Pfizer was the manufacturer of both Celebrex and Bextra. Like Vioxx, their main ingredient were said to increase one’s risk for heart attacks, strokes and other health related problems. Bextra was recalled in 2005 while Celebrex remained to be sold after its safety information was updated. $894 billion was paid by Pfizer as compensation in the Bextra and Celebrex lawsuits.

The lawsuits abovementioned may not be the same as a Darvon lawsuit but it could give an insight on the amount of settlement manufacturers care made to pay.
