Property settlement statement question and real estate contract??????

A friend of mine has just closed on a home and assumed the appliances were to be included in the sale. The contract had “no” stipulation that the appliances were to be included in the sale……also, the property disclosure was faxed to the buyer stating that “no” appliances were to be included in the sale. After receiving the fax, the buyer “circled” the appliances to be included in the sale. No “initials” were entered as to this change. Now, the buyer is wanting to know why this closed without the appliances. Should the closing attorney have checked about this? The buyer is still thinking that he is entitled to the appliances, even though there were no “initials” to this change. Do you also think that the buyer did this on purpose to cause a problem? What is your overall opinion as to how this should be handled? Should the “Real Estate Broker” been more aware of what was going on?

Any change that is made in a standard real estate sales agreement must be initialed by the party being represented to make it valid. If it is not initialed then it is like the party represented never even aggreed to it. No matter whether it was circled, check marked, or underlined it is not valid unless the party represented actually initialed to say that they agree.
So what this means is that if you sign a contract where the seller did not include the appliances you agreed to go forward without the appliances being included.
